This week the Freeborn County attorney announced that there will be no criminal charges. Freeborn County Attorney Craig Nelson said that Erickson suffered a "fairly rapid onset" of internal bleeding in his esophagus that caused a "significant loss of blood."
As to the issue of civil liability, there will undoubtedly be questions of if the medical issue was an act of God or was foreseeable for the driver or his employer. Investigation will play a important part in making that determination

I think this blog points out the distinction between potential criminal and civil liability for the same act - sometimes both, sometimes neither, sometimes civil but not criminal. Also - a criminal case can sometimes help a civil plaintiff (with proofs); but sometimes can hurt as well, when it comes to insurance coverage (lackig for intentional criminal acts). These kinds of factors make it important to have a good personal injury lawyer on your side, if injured.
