There is most likely an issue with the economy and the numbers of jobs, but even with that, there is good news that the seven reported construction related deaths was just below half compared to an average year in Minnesota. The most recent high was 2005, which saw 25 deaths.
Yearly, we see 15 deaths in Minnesota. Depending on the circumstances we have been involved in some of those cases involve an issue of third party liability. In most cases, it is covered by the workers compensation system only.
The issue of whether the death involves both a third party liability issue and worker compensation usually depends on if the death was caused by an outside source other than the employer or fellow employees.
The Minnesota Department of Labor and Industry reported that overall there were 60 fatal work injuries in 2009, down from 65 the previous year and 72 in 2007. Unfortunately, there have already been 11 reported deaths in 2010.
