I remember the reactions here in Minnesota when a police car drove into a crowd at the 1998 Holidazzle parade. The litigation lasted for a number of years. The issues included:

Governmental Immunity: What claims could be made against the government. There were municipality caps defenses and even questions of what governmental units were responsible .

Coverage: Since a vehicle was involved there were questions under Minnesota No Fault law.

Correct Party: There were questions about the event, who runs it, who oversees it, what happened with the vehicle, and product liability claims with how it happened.

Evaluation: Finding out who had a clam and what their damages included.

All issues that required investigation, litigation experience, and judicial action to finally answer.

As would be expected, those involved are concentrating on how to deal with the tragedy. Unfortunately, those responsible are most likely already getting ahead of the investigation. It is here that we often see the insurance companies working to minimize claims.

The video’s and photographs need to be found and to be examined.

The witnesses will need to be interviewed and statements will need to be analyzed for their truth. Already, stories are indicating that:

It’s sad to see such a special day end with this type of incident. Hopefully, the injured will heal quickly. Sorrow goes out for the family and friends of the woman that was killed.
