I was watching the SAG Awards red carpet the other night when along came Mark Salling. I have watched Glee a couple of times, but I don't know much about him. He was being interviewed and suddenly he started talking about frivolous lawsuits. So that got my attention.
Apparently he is facing a lawsuit claiming sexual battery, intentional infliction of emotional distress, and negligence. Sounds like it comes from a time that he was dating a Roxanne Gorzela. She is claiming he forced himself on her on multiple occasions.
Is it a frivolous claim? I would hope the system will answer that question. If he did hurt her as claimed, he deserves to pay for the damage. He also should be hammered for his use of the interview to play to a jury. Now if she is making it up, his remedies of summary judgment and making her prove her claims should all be available.
It will be worth seeing how he defends himself. The claims seem to be specific enough that much of the information should be able to be dealt with in a couple of depositions. Some of it will depend upon credibility ( the believability of the person making the statements) , but there should be more to the claims then just he said/she said.
