There is a tragic case of a young boy who contracted an STD from a condom that was left behind in a Wyndham Garden Hotel room that got my attention recently:

We get calls from time to time about incidents that happen to people in hotels or motels. A number of them have involved employee misconduct, bedbugs, or faulty maintenance. Every once in awhile there is a parking lot issue that involves No fault coverage.

This case has a number of questions with it:

Why wasn’t the room cleaned properly?

Is there liability for the person who left the condom behind?

The hotel will possibly look to the supervision issues for the condition that shouldn’t have been there to be with.

If there is a case, it will depend on how quick discovery is done and what is found out. It also will depend on the damages. It sounds very bad on first impression. Hopefully, it isn’t.

Each of these cases involve people that paid to stay where they were injured or killed. It’s important that if you are confronted with anything like this situation , you call someone who is knowledgeable to make sure the right questions are answered and all available evidence is gathered.
