The Anoka laboratory handling testing for DUI cases recently announced that it “miscalculated alcohol concentrations” in all urine tests since the beginning of the year. This news affecting Anoka, Sherburne, and Wright Counties is troubling to say the least.
The Tri-County Regional Forensic Laboratory admitted that the miscalculation produced a reading one-third higher than actual test result. Because of these inflated numbers, people have been wrongfully charged with DUIs and others have been charged with increased DUI offenses.
It is clear, that individuals have been sentenced to more jail time and paid increased fines than if the tests were properly calculated. There have been driver’s licenses, license plates, and even vehicles forfeited in some cases. Simply being charged with a serious DUI requires a mandatory $12,000.00 in bail and/or jail penalties.
This news, when combined with the continuing litigation involving the use of the Intoxilyzer 5000 breath testing machine only substantiates the need for people charged with a DUI to contact an experienced criminal law attorney.
