I’ve talked about how unfair the lack of a direct action claim is for Minnesota consumers. It is such a reward for the insurance companies to hide behind a pretend defendant as they call all the shots. Sure, we like suing little old ladies and poor dumb people who were just bad drivers that day.

I found it interesting in a recent trial that the defendant sat in the back of the courtroom and basically acted like she wanted to be anywhere else in the world. They admitted fault, so all she was , was their court prop. She read a book, wrote in a pad , slept, and then didn’t show up the last day.

I wonder if the jury understood that she really didn’t matter. That the insurance adjuster in the back was the guy who really cared.
